My am in eb-3 category with a PD jan 2007.
I applied my i-485 to NSC and it was transferred to NBC in 2009.
NBC arranged an interview with the local immigration office in April 2009.
The Immigration Offer issued a welcome notice even though my PD was not current.
I still have not received the GREEN CARD.
In March of 2011 I received an email saying that my case has been transferred to TSC "to speed up processing"
So I dont know if this is a good thing or a bad thing.
Please respond.
FYI: I have NOT changed my Job, my employer or my address.

My MTR was received by USCIS on June 25, 2009. Today I received an auto-generated email with case status update. My MTR has been denied :-(
Any advice for the next steps is appreciated.
What were you or the company applying for originally that was denied? More details please....

Thanks for that link. It is good to know that there is a possibility that I-140 PP may come back in the near future, even if in phases.
One comforting factor here is the extra $1000 is big money for no extra work which is very tempting to USCIS. So everyone knew they would bring it back as soon as the load became manageable, but the big question was when would the load become manageable.
Now from the article, it looks like it may start happening very soon.

Well, the first thing that I noticed was not the ceiling, but rather the cute little Shetland Sheepdog in the middle of the walkway. Of course, I love dogs (and especially Shelties)... ;)
I think if I stare at the image long enough, I can sometimes see the effect you're talking about, though it's not like that effect jumps out at me. IMHO, this picture is still a good study of geometric forms, whether or not it has issues with optical illusions. :)
Yes, the dog was cute, and kept staring back at me until I took the picture. Unfortunately my mind was set on getting a shot with only a person in the exit at the end of the walkway. As the dog kept looking at me I realized too late that I was blowing a chance at another picture than the one I set out to get. When I finally got is the dog was too far away.

I am dependent on our GC application. We had provided initial Finger prints in July 2007. I got an FP notice in 2009 and have just received another FP notice for next week. Meanwhile, the primary applicant on our application has not recd any biometrics appt since the 07 initial set.
Is there anything to be concerned about?
TIA

I had a VERY SIMILAR question
In my case it is simple. Current Immigration status and Manner of last entry is both H1B
In Spouse's case however here is the issue. She has used her EAD and she travelled last year using the AP.
So this is what I wrote under the 2 questions:
14) Manner of last entry: "PAROLEE"
15) Current Immigration Status: "Adjustment Of Status Pending".
IS THAT CORRECT?

Whatever maybe the motivation, but I hope there are enough politicians like him who depend on immigrant votebanks to push for CIR. Not sure, CIR even if passed would do any good EB.

I had applied for my H1B extn and got an RFE. Lawyers replied to it and its almost 7 weeks now, haven't got any reply.
Is this a usual timeframe? how long will it usually take for USCIS to take any action on the RFE's after the reply was sent with all appropriate documents?
Hi Raj Kumar,
I am completing my 9 years on H1B and my H1B is expiring. I have applied for the H1B extenstion since my I485 is still pending. What exactly does the RFE says....Can you please provide some details...it will be helpful....

Aspect #1
Close to 90% of the population--excluding Native Americans and those who were forced here in shackles--moved here out of their own volition.
Not that this has made things any easier for immigrants. In the 1850s the nativist Native American Party--reacting to a wave of Irish Catholic and German immigrants--declared that America faced "an imminent peril" from immigrants "of an ignorant and immoral character." California in the late 19th century tried to ban Asian immigration and land ownership. In 1924 immigration from everywhere outside northern Europe was severely restricted.
Aspect #2
Only immigration can provide the labor force, the expanding domestic markets and, perhaps most important, the youthful energy to keep our society vital and growing. Many bustling sections of American cities--the revived communities along the number 7 train line in Queens, N.Y., Houston's Harwin Corridor, Los Angeles' San Gabriel Valley--are dominated by immigrant enterprise. In contrast, the cities without large-scale immigration, such as Cleveland, Pittsburgh and Cincinnati, have stagnant and even declining populations.

Hi,
I received a notice this morning for my spouse's case! This is the third (or may be fourth) time they have transferred the case! The notice reads:
On May 16, 2011, we transferred this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our TEXAS SERVICE CENTER location for processing because they now have jurisdiction over the case. .......
During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to .........
All standard stuff. Not sure what that means. We are getting current on June 1st. I have not received any such notice for my case, only for my spouse's case.
By the way, we have never been interviewed, have provided fingerprints probably three times.
Does that mean that now the case needs additional 4 to 6 months of processing?
Regards,
Fall1998.

"Everybody is talking about the illegal immigrants, even though they broke the law," said Patel. "They are going to give them amnesty, but the high-skilled people like us, who are contributing to the U.S. economy - we are overlooked."
Good article giving us some great exposure. Just noticed the above line in the article..... I hope there is no political impact of the use of "amnesty" in the statement. I guess I am being a bit paranoid!

Here is how you are being perceived in this country (full article link below):
"The process of converting an H-1B immigrant to a permanent visa resident is a long, expensive, tortured process. know of cases that took longer than seven years. My companies liked this arrangement, because it made the workers into long-term indentured servants, who lacked the freedom to quit and work anywhere else, neither could they complain about anything unless they wanted the companies to pull their sponsorship of them"

There are a lot of high-powered organizations lobbying/advocating in Washington to ensure that there are more temporary workers - because it is in their benefit. No one emphasizes on green card backlogs!
Immigration Voice is the only organization fighting exclusively for reducing green card backlogs and providing you the much needed flexibility to change jobs, get your green card, allow your spouse work, etc.!
Think about the situation and join the fight - participate in IV Advocacy for your benefit!

Hi! I'm H1B holder and my company is willing to sponsor the green card. I'm coming from Eastern Europe (Moldova) and in US am working as software developer, I guess it's EB-3, right? I graduated in Romania Bachelor Degree in Mathematics & Computer Science (4 years) and Master Degree in Computer Science & Engineering (2 years). My work experience is more than 7 years. Please advice how to proceed to get this process done properly, legally and fast, reasonably possible and how much time it would probably take. Thanks in advance!
Try EB-3, the ride will be much more fun and exciting compared to EB-2. did you go to Universitatea din Bucuresti?

I like the colors, and the silhouetted person. Personally, I think cropping out a lot of the top (roughly the upper 1/2 of the picture) would make it more interesting. This would also give it a panorama-like appearance.

Immigration Law from Houston Immigration Lawyer - Annie Banerjee Has Just Posted the Following:
The fees for most CIS applications are astronomical. For instance the fee for N-400 to become a US Citizen is $675/- The fee for adjusting status to become a permanent resident is $1010/- Many people simply cannot afford that. However previously there were no forms and no guidelines to filing anything without fees with the CIS. If anyone filed a form and could not afford a fee, they had to write a letter. But the mailroom personnel at CIS either does not read or perhaps cannot read. So the form used to be returned asking us to send the check. You could go back and forth and in the mean time loose time or even status.
Even more egregious were fees paid due to CIS' mistake. For instance if the CIS in clear cut error denied your case, you had to file a motion to reopen for $585/- We even had a case once where the CIS collected a fee for a I-765 (EAD) filing for $340/- and lost the file. When we traced and send them the check, the reply was that my bank should ask for the money back. My bank, Bank of America, did not know how to. So we simply paid again and refiled.
Now the CIS is proposing a form: I-912 which will establish clear guidelines for fee waivers. Hopefully the form in its approved version will have no fee requirements for CIS' mistakes along with applications for applicants below the poverty level.
Don't just start spending the money that you were saving for the CIS fees yet though. Sometimes these forms take years to come to fruition. As for me, I will believe it when I ultimately see it.
